Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Guest," "you," or "your") and Gatlinburg's Best Cabins ("Company," "we," "us," or "our") governing your use of our website and vacation rental services. By making a reservation through our website or booking platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website, making a reservation, or staying at any of our properties, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

You represent that you are at least 21 years of age and have the legal authority to enter into this agreement. The primary guest making the reservation must be present during the entire stay and is responsible for all members of their party.

2. Booking & Reservations

Reservation Confirmation: A reservation is confirmed only after we receive full payment or required deposit and send you a written confirmation. Availability is subject to change until your booking is confirmed.

Accurate Information: You agree to provide accurate, current, and complete information during the booking process. False or misleading information may result in cancellation of your reservation without refund.

Occupancy Limits: The maximum occupancy for each cabin is clearly stated. Exceeding the maximum occupancy is strictly prohibited and may result in immediate termination of your stay without refund. Only registered guests are permitted to stay overnight.

Minimum Stay Requirements: Certain dates may require minimum night stays, particularly during holidays and peak seasons. These requirements will be clearly stated during the booking process.

3. Payment Terms

Pricing: All prices are quoted in US dollars and include applicable taxes and fees as displayed during checkout. Prices are subject to change without notice; however, your confirmed booking price will be honored.

Payment Schedule: A deposit may be required at the time of booking, with the remaining balance due prior to check-in. Full payment terms will be provided during the booking process.

Payment Methods: We accept major credit cards and other payment methods as indicated on our website. All payments are processed securely through our third-party payment processors.

Additional Charges: Additional fees may apply for early check-in, late check-out, excessive cleaning, damages, or violations of property rules. These charges will be charged to the payment method on file.

4. Cancellation Policy

Our cancellation policy varies based on the timing of your cancellation:

• 60+ days before check-in: Full refund minus a processing fee
• 30-59 days before check-in: 50% refund of the total booking amount
• Less than 30 days before check-in: No refund

Holiday and peak season bookings may have stricter cancellation policies, which will be clearly communicated during the booking process.

Early Departure: No refunds will be provided for early departures or unused nights.

Modifications: Booking modifications are subject to availability and may result in price adjustments. Modifications made within the cancellation window may be treated as a cancellation.

5. Check-In & Check-Out

Check-In Time: 4:00 PM local time (unless otherwise arranged)

Check-Out Time: 10:00 AM local time (unless otherwise arranged)

Early check-in or late check-out may be available upon request and may incur additional fees. All requests are subject to availability and must be arranged in advance.

Check-in instructions, including property access codes, will be provided prior to your arrival. You are responsible for ensuring all members of your party understand and follow check-in procedures.

6. Guest Responsibilities

As a guest, you agree to:

• Treat the property, furnishings, and amenities with care and respect
• Report any damages, maintenance issues, or safety concerns immediately
• Comply with all property rules, house rules, and local laws
• Be responsible for the conduct of all members of your party and any visitors
• Leave the property in a reasonable condition upon check-out
• Not sublease, assign, or transfer your reservation to any other party
• Keep the property secure by locking all doors and windows when away

7. Property Rules

The following rules apply to all properties:

• No Smoking: All properties are strictly non-smoking, including e-cigarettes and vaping. Smoking must be done outdoors in designated areas. A minimum $500 cleaning fee will be charged for violations.
• No Parties or Events: Parties, events, and gatherings that exceed the registered guest count are strictly prohibited.
• Quiet Hours: Please observe quiet hours between 10:00 PM and 8:00 AM out of respect for neighbors.
• Pets: Pet policies vary by property. If pets are permitted, additional fees and rules apply. Undisclosed pets will result in immediate eviction and forfeiture of all rental fees.
• Fireworks: Fireworks are prohibited on all properties.
• Hot Tub Rules: Follow all posted hot tub safety guidelines. No glass containers in or near the hot tub.

Violation of property rules may result in immediate termination of your stay without refund and additional fees for any damages or excessive cleaning required.

8. Damages & Security Deposit

Security Authorization: We may place a temporary hold on your credit card as a security authorization. This hold will be released within 7-14 business days after checkout, provided no damages or additional charges apply.

Damage Liability: You are financially responsible for any damages to the property, furnishings, appliances, or amenities caused by you or any member of your party during your stay. This includes but is not limited to:

• Broken or damaged furniture, fixtures, and appliances
• Stains, burns, or damage to linens, carpets, or upholstery
• Missing items or theft
• Excessive cleaning requirements beyond normal use
• Damage to outdoor areas, decks, hot tubs, or landscaping

Damages will be assessed and charged to the payment method on file. For damages exceeding the security deposit, you agree to pay the additional amount within 14 days of invoice.

9. Limitation of Liability

Assumption of Risk: You acknowledge that vacation rental properties, including mountain cabins, inherently carry certain risks. These risks include but are not limited to: uneven terrain, wildlife encounters, weather-related hazards, hot tub use, fireplace use, steep driveways, and outdoor activities. You voluntarily assume these risks.

No Warranty: The property is provided "as is" without warranties of any kind, express or implied. We do not warrant that the property will meet your expectations or that your stay will be uninterrupted or error-free.

Limitation: TO THE MAXIMUM EXTENT PERMITTED BY LAW, GATLINBURG'S BEST CABINS, ITS OWNERS, MANAGERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PROPERTY OR SERVICES, INCLUDING BUT NOT LIMITED TO:

• Personal injury or death (except where caused by our gross negligence)
• Property damage or loss, including theft of personal belongings
• Utility interruptions (power, water, internet, cable)
• Mechanical failures of appliances, HVAC, hot tubs, or other amenities
• Acts of nature, weather events, or natural disasters
• Actions of third parties, neighbors, or wildlife
• Road conditions or accessibility issues

Our total liability for any claim shall not exceed the total amount paid for your reservation.

10. Hold Harmless & Indemnification

You agree to hold harmless, defend, and indemnify Gatlinburg's Best Cabins, its owners, operators, managers, employees, agents, and property owners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the property and services
• Your violation of these Terms of Service
• Your violation of any laws, regulations, or third-party rights
• Any injury, death, or property damage occurring during your stay
• The actions or omissions of you or any member of your party
• Any claims made by third parties as a result of your stay

This indemnification obligation shall survive the termination of your reservation and these Terms.

11. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, severe weather, fires, floods, earthquakes, pandemics, epidemics, government actions, war, terrorism, strikes, utility failures, or acts of God.

In such events, we will work with you to reschedule your stay or provide alternative accommodations when possible. Refunds for force majeure events will be evaluated on a case-by-case basis.

12. Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.

Informal Resolution: Before initiating any formal dispute proceedings, you agree to contact us first to attempt to resolve any dispute informally. Most concerns can be resolved quickly and satisfactorily through direct communication.

Jurisdiction: Any legal action or proceeding arising from these Terms or your use of our services shall be brought exclusively in the state or federal courts located in Sevier County, Tennessee. You consent to the personal jurisdiction of such courts.

Limitation Period: Any claim arising from your stay must be brought within one (1) year from the date of the incident giving rise to the claim.

13. Amendments to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. The "Last Updated" date at the top of this page indicates when the Terms were last revised.

Your continued use of our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

For existing reservations, the Terms in effect at the time of booking will generally apply, unless we notify you of material changes that affect your reservation.
